Department of Family and Community Services (FaCS)
If a child's life becomes risky, dangerous, or threatened, FaCS has power to intervene and remove children and place them with safer carers like family or foster care.
The process is supervised and if necessary determined by a magistrate in the Children's Court. Children, parents, and other people with an interest in the court case. They can have significant impact on management of the court process and the final outcome.
The law places emphasis on achieving restoration of children to their parents wherever possible.
A Children's Court case takes months and may involve parents undertaking parental skills or other programs designed to adequately equip them to resume the care of their children.
Departmental investigations and assessments may also be undertaken as well as conferences with the Court Registrar coordinating meetings of all parties. We are experienced in representing people involved in a Children's Court case.
At these times it's vital that parents maintain good working relationships with FaCS; That they strictly comply with child contact regimes; And that they be open and receptive to guidance from experts.
